The name of the petitioner came in the statement of one witness namely, Lalan Kumar son of Yogendra Raut. The police recorded the statement of the aforesaid witness Lalan Kumar. The police got information that looted potatoes had been kept in the house of Yogendra Raut, who happens to be the father of the aforesaid witness Lalan Kumar. The aforesaid witness Lalan Kumar stated before the police that the room from which the looted potatoes had been recovered, had been given on rent to the petitioner but the aforesaid witness admitted that no document in respect of the same was executed. No.51295 of 2014 (3) dt.08-04-2015 2/2 available on the case diary that except the oral statement of the aforesaid witness, there is nothing on record to show that the rooms had been given on rent to the petitioner. Para -3 of the petition reveals that petitioner does not have any criminal antecedent.

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Motihari in connection with Sugauli P.S.Case No.294 of 2014.
