Heard learned counsel for the petitioner and learned counsel for the State The petitioner is apprehending his arrest in connection with C.A. Case No. (Complaint Case No. 4471/2014) for the offences instituted under Sections 323 and 384 of the IPC. The prosecution story, in brief, is that the petitioner alongwith some unknown miscreants stopped the complainant, they abused and assaulted him and on the point of pistol forcibly took away Rs. 4000/- from his upper pocket and snatched his wrist
Patna High Court Cr.Misc. No.39448 of 2015 (2) dt.28-09-2015 2/3 watch worth Rs. 1500/-. The complainant was put in fear of death. It has been submitted on behalf of the petitioner that the petitioner has falsely been implicated in the present case. It is further submitted that the petitioner is next door neighbour of the complainant. The present case has been instituted due to land dispute between the parties. Prior to this complaint case, the complainant also had instituted a case against the petitioner in which the final form was submitted by the police. It is further submitted that the petitioner is ready to deposit an amount of Rs. 5,000/- in the court below which shall be subject to final disposal of the case.
On behalf of the State it has been submitted that the petitioner is named in the F.I.R.
Considering the aforesaid facts and circumstances, it is directed that the petitioner shall deposit an amount of Rs. 5,000/- in the court below which shall be subject to final disposal of the case and on doing so, let the petitioner above named, be released on bail in the event of his arrest or surrender before the learned court below within a period of four weeks from today in connection with C.A. Case (Complaint Case) No. 4471/2014 on furnishing bail bond of Rs. 10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned
