11-08-2015 Heard learned counsel for the petitioner and learned A.C. to Standing Counsel - 2.
In the present writ petition, the petitioner has made a limited prayer for directing the respondents, particularly; respondent no. 2/District Magistrate, Gaya i.e. appellate authority to decide the Confiscation Appeal (Forest) No. 14 of 2014 expeditiously.
In view of limited prayer made by learned counsel for the petitioner, the Court is of the opinion that without asking for any counter affidavit, the writ petition can be disposed of with an observation that the learned District Magistrate, Gaya, who is appellate authority may take appropriate steps so that appeal i.e.
Patna High Court CWJC No.1751 of 2015 (2) dt.11-08-2015 2/2 Confiscation Appeal (Forest) No. 14 of 2014 may come to its logical end without unnecessary delay. Keeping in view the fact that in the case, a pick-up van has been confiscated, the District Magistrate, Gaya is required to take decision preferably within a period of three months from the date of receipt/production of a copy of this order.
With above observation and direction, the writ petition stands disposed of.
