The petitioner apprehends his arrest in Dhaka P.S. Case No.316 of 2018 registered under Section 30(a) of the Bihar Prohibition and Excise Act.

Small quantity of nepali liquor is said to have been recovered from the straw house of the petitioner. The learned counsel for the petitioner submits that straw house was open and anybody can keep and conceal some objectionable articles therein for that the petitioner cannot be held responsible.

Considering the aforesaid facts and nature of allegation made against the petitioner, let the petitioner, above named, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt of

No.75965 of 2018(2) dt.21-12-2018 2/2 the order, be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned 7th Addl. Sessions Judge-cum-Special Judge, Excise, Motihari, East Champaran in connection with Dhaka P.S. Case No.316 of 2018, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
