JUSTICE VINOD KUMAR SINHA ORAL ORDER 09-08-2019 Petitioner seeks bail in anticipation of his arrest in connection with Singhwara P.S. Case No. 47 of 2014, corresponding to G.R. No. 544 of 2014, registered for the offences under Sections 135 and 139 of Electricity Act. Prosecution story is of commission of theft of electricity by the petitioner in medicine shop and Aman X-ray. Submission of learned counsel for the petitioner is that he is not the owner of the medicine shop or X-ray plant, he is only a worker there and other co-accused has been granted anticipatory bail by the court below itself.
Heard learned APP and learned counsel for the NBPDCL, who has submitted that the premises belongs to the petitioner and the case has been lodged in the year 2014 and
Patna High Court CR. MISC. No.49907 of 2019(2) dt.09-08-2019 2/2 after five years petitioner has prayed for anticipatory bail and the co-accused, who has been granted anticipatory bail, is the guard of the company, as such the above point is not available to the petitioner.
In view of above facts and circumstances, I am not inclined to grant the privilege of anticipatory bail to the petitioner. He may surrender and pray for regular bail, which shall be considered on its own merit.
Accordingly, this application is dismissed.
