Heard the learned counsel for the petitioners as well as the learned counsel for the informant.

The petitioners apprehend their arrest in connection with Bypass P.S. Case No. 289 of 2021 registered for offence punishable under sections 120(B), 420, 406, 467, 468, 471, 427/34 of the Indian Penal Code and later on, section 409 of the Indian Penal Code has been added.

Patna High Court CR. MISC. No.64966 of 2021(2) dt.21-07-2022 2/3 Petitioner no. 1 is Director of Hemtrix Agritech Pvt. Ltd. Petitioner nos. 2 and 3 are employee of Hemtrix Agritech Pvt. Ltd.

As per allegation, earlier Rs.25,00,000/- were invested in the company by the informant and after setting of other liabilities, the investment of the informant was Rs.23,60,000/-. Some dispute arose between the informant and the petitioners. The informant wanted to take back his invested money, but the petitioners threatened to implicate him in false case. The learned counsel for the petitioners has submitted that petitioner no. 1, who is Director of the company, and the informant have compromised the case and petitioner nos. 2 and 3 are merely employees of that company. Petitioner no. 1, at the time of compromise, has assured to return the entire amount of Rs.23,60,000/- to the informant at the time of compounding the FIR before this Court.

The learned counsel for the informant has submitted that though it is true that the matter has been compromised between petitioner no. 1, who is Director of the Company, but there is no compromise of the informant with petitioner nos. 2 and 3. It appears that the Director of the company has compromised the case with the informant and he is ready to

Considering the above-mentioned facts and circumstances, the petitioners above-named, in the event of their arrest or surrender, within four weeks from today, are directed to be released on bail on furnishing bail bonds of Rs.10,000/- each with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-VI, Patna City, Patna in connection with Bypass P.S. Case No. 289 of 2021, subject to condition as laid down under section 438(2) Cr. P.C. Office shall ensure that all defects are removed by the petitioners within the stipulated time mentioned hereinabove, failing which, the matter shall be brought to the notice of this Court.
