Mr.Anuj Kumar Shrivastava ====================================================== CORAM: HONOURABLE MR. JUSTICE NAWNEET KUMAR PANDEY ORAL ORDER 20-07-2022 The learned counsel for the petitioner is directed to remove all the defects pointed out by the Stamp Reporter within one month.
Heard the learned counsel for the petitioner and learned APP for the State.
The petitioner apprehends his arrest for the offences alleged under Sections 304(B) and 34 of the Indian Penal Code, registered in connection with Sikandra P.S.case No. 177 of 2021.
The informant Malo Devi is sister-in-law (bhabhi) of the deceased Puja Kumari. As per the allegation, the marriage of Puja Kumari was solemnized with Sohan Chauhan in the year 2021. The customary presents were given at the occasion
Patna High Court CR. MISC. No.63261 of 2021(2) dt.20-07-2022 2/3 of marriage. Two days prior to the occurrence the deceased Puja Kumari informed the informant that her husband Sohan Chauhan, father-in-law and mother-in-law were demanding a motor-cycle in dowry. On 2nd July, 2021 the informant came to know that her sister-in-law Puja Kumari was done to death. When she went to her matrimonial house, she saw her deadbody. The learned counsel for the petitioner has submitted that the petitioner is mother-in-law and has no concern with day to day affair with the couple.
From perusal of the FIR it shows that the deceased was done to death within 15 days of her marriage. There is specific allegation on the husband and family members including the petitioner that they inflicted atrocities upon the deceased two days before her death. This fact was communicated to the informant by the deceased herself. In the impugned order it has been mentioned that as per the post mortem report there was profound bleeding from the nose of the deceased.
On the basis of above mentioned observations, I do not think it a fit case for grant of anticipatory bail to the petitioner. Her prayer for anticipatory bail is hereby rejected.
Patna High Court CR. MISC. No.63261 of 2021(2) dt.20-07-2022 3/3 Office shall ensure that all defects are removed by the petitioner within the stipulated time as provided hereinabove, failing which the matter shall be brought to the notice of this Court.
