The petitioner apprehends his arrest in connection with Pipra P.S. Case No. 297 of 2015 registered under Sections 147, 148, 149, 323, 324, 325, 307, 352, 379, 447, 504 and 506 of the I.P.C. pending in the Court of C.J.M., Motihari, East Champaran.
The accusation is that in course of dispute, this petitioner gave fasuli blow at the informant, in which he sustained injury at his lower limb.
Submission is that due to land dispute, the occurrence took place and there is also counter case lodged by Sushma Sinha, sister-in-law of the informant.
Patna High Court Cr.Misc. No.33293 of 2016 (2) dt.20-08-2016 2/2 Having considered the facts and circumstances of the case and nature of the allegation, I am not inclined to allow the prayer of the petitioner for anticipatory bail. Accordingly, prayer of the petitioner for bail is rejected.
However, petitioner is directed to surrender before the Court below within a period of 4 weeks and pray for regular bail, which will be decided on its own merit without being prejudiced by the present order.
