2. This is the 2nd attempt on behalf of the petitioner for anticipatory bail in connection with Excise P.S. Case No. 342 of 2021 registered for the offence punishable under Section 30(a) of the Bihar Prohibition and Excise (Amendment) Act, 2018.

3. The petitioner has preferred this application for anticipatory bail after three years of its rejection. Earlier the prayer of the petitioner for anticipatory bail was rejected vide Cr. Misc. No. 1539 of 2022 dated 14.02.2022.

4. In view of the judgment of the Hon'ble Supreme Court in the case of G.R. Ananda Babu Vs. State of Tamil Nadu and another reported in 2021 SCC OnLine SC 176, the

Patna High Court CR. MISC. No.56235 of 2025(2) dt.19-09-2025 2/2 second anticipatory bail is not maintainable and therefore, the same is rejected.

5. The petitioner is directed to surrender before the Court below on or before 31st October, 2025 failing which the Superintendent of Police, Gopalganj will take all possible steps to arrest the petitioner as he is an absconder.

6. Let a copy of this order be communicated to the Superintendent of Police, Gopalganj through FAX for its compliance forthwith.
