In this case, the petitioner is anticipatory seeking bail in connection with Madhepura SC/ST P.S. Case No.28 of 2015 registered for offences under sections 341, 323, 504, 506, 420 I.P.C. and section 3 (1) (v) of the SC/ST (Prevention of Atrocities) Act.

Allegation has been made that the petitioner had taken Rs. 10,000/- from the wife of the informant on the pretext of providing the Indira Awas, but he could not make arrangement for the Indira Awas. When she had gone for return of the money, the petitioner used filthy language and called her by caste name. Today a supplementary affidavit has been filed showing Rs.10,000/- has been deposited in the Government

Patna High Court Cr.Misc. No.26916 of 2016 (4) dt.29-07-2016 2/2 Treasury. Let the money be kept in the Government fund and after conclusion of the trial, the court below will pass an appropriate order about the money deposited by the petitioner. As the petitioner has deposited the money, in such view of the matter, in the event of arrest or surrender before the court below within a period of four weeks from today, the petitioner, above named, be enlarged on bail on his furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Madhepura in connection with Madhepura SC/ST P.S. Case No.28 of 2015, subject to the condition as laid down under Section 438 (2) Cr. P.C.
