JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 28-09-2015 Heard learned counsel for the petitioners and learned Assistant Public Prosecutor for the State. This application for grant of anticipatory bail arises out of Banka (SC/ST) PS Case No. 54 of 2014, disclosing offences under Sections 147, 149, 341, 323, 447, 307, 325, 504 and 506 of the Indian Penal Code and read with Section 3(i)v)(x) of the SC/ST (Prevention of Atrocities) Act.
Learned counsel for the petitioners states that the
Patna High Court Cr.Misc. No.39064 of 2015 (2) dt.28-09-2015 2/2 petitioners are co-operating in investigation with the police and they have appeared before the Investigating Officer pursuant to notices issued to them and have been released on furnishing bond by the police under Section 41(1)(a) of the Code of Criminal Procedure, 1973.
It cannot be said that the petitioners have any apprehension of arrest at present. If occasion arises in future, the petitioners shall be at liberty to approach the Court of learned Sessions Judge or this Court for grant of anticipatory bail. This application stands disposed of.
