JUSTICE NAVANITI PRASAD SINGH ORAL ORDER 05-10-2016 The petitioner apprehends his arrest in Jehanabad P.S. Case No.272 of 2016 for the offences under Sections 366 and 506/34 of the Indian Penal Code.

The allegation by the informant is that he was taking his physically challenged wife to see their 14 years old son, who was sick. On reaching the bus stop, she was asked to sit on bench and he went to make some purchase. After return, he was told that Santu Kumar and Sashi Kumar, the sons of the petitioner, came and took her away telling the neighbour that taking to get some form written. On the next day, it is alleged that the petitioner threatened the informant as to why he had gone to the Superintendent of Police to make complaint. Thereafter, this F.I.R. is being lodged.

It is submitted that this petitioner has no role to play whatever has been done. The two sons of the petitioner to whom

Learned A.P.P. points out that the girl has not yet been recovered nor the two sons of the petitioner are available anywhere.

Be that as it may, as the main role has been ascribed to the two sons of the petitioner, in the event of his arrest or surrender within five weeks from today, the petitioner abovenamed shall be released on bail on his furnishing bonds of Rs.10,000.00 (Rupees Ten Thousand) with two sureties of like amount each to the satisfaction of C.J.M., Jehanabad in connection with Jehanabad P.S. Case No.272 of 2016, subject to all conditions as laid down in Section 438 (2) of the Criminal Procedure Code.
