Petitioners are apprehending their arrest in connection with a case registered for the offence under Section 4 of the Dowry Prohibition Act. They are brothers, sister-in-law and mother respectively of one Abhimanyu Kumar whose marriage was fixed with the daughter of opposite party no. 2 but the same could not be materialised and the present case has been instituted alleging demand of dowry by Abhumanyu Kumar and the family members. In the case of Abhimanyu Kumar this Court under order no. 2 dated 24.06.2015, passed in Cr. Misc. No. 21973 of 2015 has
Patna High Court Cr.Misc. No.40251 of 2015 (2) dt.07-10-2015 2/2 noticed the complainant-opposite party no. 2 further directing that until service of notice on opposite party no. 2 and his appearance through lawyer no coercive steps be taken against Abhimanyu Kumar.
The prayer made in the instant petition on behalf of the petitioners is disposed of directing them to surrender in the court below within a period of four weeks from the date of receipt/ production of a copy of this order in the court below but no coercive steps be taken against the petitioners in connection with Complaint Case No. 337/2014, Tr. No. 2689/2014 until disposal of Cr. Misc. No. 21973 of 2015 filed by Abhimanyu Kumar and after disposal of the said application the prayer for grant of bail to the petitioners be also considered by the court below in the same light as is done in the case of Abhimanyu Kumar.
This petition is, accordingly, disposed of.
