ANJANA PRAKASH ORAL ORDER 09-01-2015 Heard learned counsel for the Petitioners and the State. The Petitioners seek bail in Motihari Town P.S. case No.190 of 2005 instituted for the offence under Sections 328, 304, 120B and 201/34 of the Indian Penal Code, pending in the court of the Chief Judicial Magistrate, East Champaran, Motihari. Considering that the Petitioners despite having been named in the First Information Report did not surrender for a number of years, I am not inclined to grant bail to the petitioners at this stage.

Prayer for bail is rejected.

However, the Petitioners may renew his prayer for bail after framing of charge provided their case is not bifurcated for the same purpose.
