JUSTICE DINESH KUMAR SINGH ORAL ORDER 17-09-2015 Heard learned counsels for the petitioner and the State. The petitioner being the brother in law (bhaisur) of the complainant is apprehending arrest in a complaint case wherein process has been directed to be issued after cognizance being taken for the offences punishable under Sections 323, 354 and 379 of the Indian Penal Code.

The prosecution case is that for a dispute with regard to taking water from the government hand pump co-accused Puspa Devi and Meena Devi abused complainant and her mother thereafter, the complainant went inside her house. Subsequently, the co-accused Puspa Devi, Meena Devi, sanjay Ram and Ajay Ram came at the house of the informant and started abusing the informant, the informant again went inside the house. It is further alleged that the petitioner entered into the house, tore the blouse of

No.37677 of 2015 (2) dt.17-09-2015 2/2 the informant, made assault on the leg and fists of the informant pelted bricks and snatched gold chain, ear-rings etc. It is also alleged that when mother of the informant came to rescue she was also assaulted by the accused persons.

It is submitted by learned counsel for the petitioner that for a petty dispute the accusation has been levelled. For the occurrence of 18.02.2014, the complaint case was filed on 22.02.2014. Moreover, a statement has been made in paragraph 3 of the petition that the petitioner has no criminal antecedent. Considering the aforesaid facts, let the above named petitioner be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate, 1st Class, Gopalganj in connection with Complaint Case No.502 of 2014, subject to the conditions as laid down under Section 438(2) Cr.P.C.
