JUSTICE DINESH KUMAR SINGH ORAL ORDER 06-10-2015 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 363,366A,376,379 and 120B/34 of the Indian Penal Code.

The accusation is of kidnapping the minor daughter of the informant and ravishing her.

It is submitted by the learned counsel for the petitioner that in 164 Cr.P.C. statement the victim got her age recorded as 16 years when the court assessed as such where she has supported the accusation but from the perusal of the aforesaid statement it appears that the victim went in the company of the petitioner of her own.

Be that as it may, considering the nature of accusation,

Patna High Court Cr.Misc. No.39970 of 2015 (2) dt.06-10-2015 2/2 let the learned court below consider the prayer for regular bail of the petitioner in case the petitioner surrenders within six weeks from today in connection with Dhamdaha P.S. Case No. 312 of 2014 pending in the court of learned J.M. Ist Class, Purnea. This application is disposed of with the aforesaid observation/direction.
