Subsequent thereof, instant petition has been filed with a prayer to accept the identity of the petitioner as Mantun Singh, Son of Suresh Prasad Singh @ Suresh Singh, resident of village- Hadipur, P.S. -Bachhwara, District- Begusarai. By way of supplementary affidavit photocopy of Voter I-card (Annexure3) has been filed to say that petitioner happens to be Mantun Singh @ Mantun Kumar, Son of Suresh Prasad Singh @ Suresh Singh, resident of village- Hadipur, P.S. -Bachhwara, DistrictBegusarai. Patna High Court Cr.Misc. No.38759 of 2015 (3) dt.02-09-2015 if allowed to go in more detail will be futile in the background of the fact that it happens to be the Investigating Officer who is to identify the culprit. That being so, the prayer of the petitioner is disposed of directing the learned lower court to firstly got the identity of the petitioner ascertained in legal way and then, will proceed to pass appropriate order in the background of direction given under Cr. Misc. No.7142 of 2015. In terms thereof, Cr. Misc. No.38759 of 2015 is disposed of.
