JUSTICE NAWNEET KUMAR PANDEY ORAL ORDER 03-03-2022 Learned counsel for the petitioner is directed to remove all the defects pointed out by the Stamp Reporter within one month. Heard learned counsel for the petitioner as well as learned APP for the State.

The petitioner apprehends his arrest in connection with Rahui (Wena) P.S. Case No. 100 of 2020, registered for the offences punishable under Sections 341, 323, 379, 307, 504 and 506 of the Indian Penal Code.

Learned counsel for the petitioner has submitted that the FIR has been lodged after 13 days of the alleged occurrence. By drawing my attention towards Annexure-2 learned counsel has submitted that the informant himself has filed an affidavit before the court of learned Additional Chief Judicial Magistrate-I, Nalanda, Biharsharif in which the informant has stated that

No.15436 of 2021(3) dt.03-03-2022 2/2 his son, injured Abhishek Patel, never apprised him that the present petitioner has fired shot on him nor he stated that the petitioner has snatched gold chain from his neck. The informant has also stated in that petition that the present petitioner is innocent. Considering the above-mentioned facts and circumstances let the petitioners, in the event of his arrest or surrender, be released on anticipatory bail within four weeks before the learned court below on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-I, Biharsharif Nalanda in connection with Rahui (Wena) P.S. Case No. 100 of 2020, subject to the conditions as laid down under Section 438(2) Cr.P.C. Office shall ensure that all defects are removed by the petitioner within the stipulated time provided in para-1 hereinabove, failing which the matter shall be brought to the notice of this Court.
