The petitioner seeks bail in Basopatti P.S. Case No. 326 of 2020 (C.R.I. No. 2525 of 2020), registered for the offence under Section 394 of the Indian Penal Code and Section 27 of the Arms Act.

As per the prosecution case, while the son of informant was returning home from his shop, three persons came on a motorcycle and fired on him and snatched his bag containing cash and ornaments.

It is submitted on behalf of petitioner that name of the petitioner surfaced during course of investigation. No looted article has been recovered from the possession of the petitioner and till date, T.I.P. has not been carried out. Petitioner is in custody since 08.04.2021.

Patna High Court CR. MISC. No.63589 of 2021(2) dt.08-03-2022 2/2 Learned A.P.P. for the State has opposed the bail petition.

Considering the aforesaid facts and circumstances as well as period of custody and the fact that till date, T.I.P. has not been held, the bail petition of petitioner is allowed. Let the above named petitioner be released on bail on furnishing bailbond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate 1st Class, Madhubani in connection with Basopatti P.S. Case No. 326 of 2020 (C.R.I. No. 2525 of 2020).
