The petitioner has preferred this application for grant of regular bail in a case registered under sections 307, 341, 323, 504 and 34 of the Indian Penal Code and section 27 of the Arms Act.

As per the prosecution case, over a minor altercation with five accused persons on two motorcycles it is stated that one of the accused shot at the informant hitting him in his leg. On hulla being raised, the accused persons escaped but one of them was left behind and he disclosed his name as Anand Kumar. He further disclosed the name of Simant Kumar as the accused who had shot at the informant as also the names of two others which included the petitioner herein. It is submitted by learned counsel for the petitioner

Patna High Court CR. MISC. No.63770 of 2021(3) dt.18-04-2022 2/2 that the petitioner has been falsely implicated in the case. Even as per the allegations in the FIR it would transpire that the allegation against the petitioner is general and omnibus in nature. The allegation of firing is against Simant Kumar and not the petitioner herein who was not caught at the place of occurrence. The petitioner is in custody since 14.7.2021 and chargesheet has been submitted in the case.

Having heard learned counsel for the parties and taking into consideration the facts of the case together with the petitioner having remained in custody for over 9 months and charghesheet having been submitted in the case, the Court directs the petitioner to be enlarged on bail in connection with Goreakothi P.S. Case no. 119 of 2020 on furnishing bail bond of Rs.10,000/ (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M.-X, Siwan.
