JUSTICE VINOD KUMAR SINHA ORAL ORDER 20-12-2018 Earlier prayer for bail of the petitioner along with another co-accused was rejected by this Court vide order dated 5.9.2018 passed in Cr.Misc.No. 44712 of 2018 on the allegation that large number of accused persons, including the petitioner chased one Abhishek Yadav and made indiscriminate firing and firing made by co-accused Rahul Yadav hit the daughter of informant, causing her death.

Learned counsel for the petitioner submits that he is not the assailant and he is in custody since 27.5.2018. Heard learned APP also.

Having heard both sides and in the facts and circumstances, as stated above, at this stage I am not inclined to grant bail to the petitioner. However, once charge has been framed in this case, petitioner may renew his prayer for bail.
