The petitioner Kailash Yadav seeks bail in Harnaut P.S. Case No. 129 of 2014, registered for the offences punishable under Section 307 and some other Sections of the Indian Penal Code.

It appears that a truck and a bus collided each other in which a child was killed and many persons sustained injuries on account of road accident. Many persons of the locality assembled there and started pelting stones on the police party. Learned counsel for the petitioner submits that the petitioner is named in the FIR but as a member of the mob. The petitioner has not committed any overt act rather he was onlooker as the accident has taken place and no specific allegation is made

Patna High Court Cr.Misc. No.51952 of 2014 (2) dt.05-01-2015 against the petitioner.

Learned APP did not dispute the facts.

Having considered the facts aforesaid and the fact that the petitioner is in jail since 20.08.2014, he above named is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Sri R.V.S. Parmar, the learned Judicial Magistrate, 1st Class, Nalanda at Biharsharif in connection with Harnaut P.S. Case No. 129 of 2014.
