The petitioner is in custody since 13.10.2018 in connection with Special Case No. 9730 of 2018 arising out of Chowk P.S. Case No. 407 of 2018 for the offence registered under Section 30(a) of the Bihar (Prohibition) Excise Act, Patna. Learned counsel for the petitioner submits that though the alleged recoveries are said to have been made from the house of the petitioner, actually the said recoveries were from the joint house of the petitioner, who is old lady having several ailments.

Considering the aforesaid facts and circumstances of the case and that the petitioner has no criminal antecedent, let
