2. The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 126(2), 115(2), 303(2), 352, 308(5), 351(2) and 3(5) of the B.N.S., 2023.
3. According to prosecution case, Uday Kumar @ Jay Prakash Kumar and some persons demanded extortion money from him, which he refused. On 17.08.2024 at around 5:50 PM, while he was returning to his village Sadasi Chak from Kinari
2/4 Market, the accused persons allegedly stopped his motorcycle, abused and assaulted him, and pushed him into water by pressing his neck. They also snatched Rs.25,000/- from his pocket and threatened to kill him if he filed a case. Based on this allegation, an FIR has been registered.

Learned counsel for the petitioner submits that the allegations against this petitioner is general and omnibus in nature and there is nothing specific that this petitioner stopped the motorcycle of the informant and began to abuse and assault by pushing him into the water and by pressing his neck, snatched some amount from the informant, which details forms part of the F.I.R. Learned counsel for the petitioner fairly submits that he has three criminal antecedent in which he is on bail and undertakes that he would not commit any such offence of the kind in future and the prosecution may be directed that in the event of subsequent case being registered of similar nature, they upon finding complicity, may be directed to file appropriate application for cancellation of bail.
5. Learned APP for the State opposes the prayer for anticipatory bail application.
6. Considering the aforesaid facts and circumstances that there is no specific allegation against the petitioner rather
3/4 the allegation is general and omnibus in nature. Accordingly, this Court is inclined to grant the privilege of anticipatory bail to the petitioner.
7. Let the petitioner, above named, in the event of his/her arrest or surrender before the Court below within a period of thirty days from the date of receipt of the order, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M, Jehanabad, in connection with Jehanabad (Kalpa) P.S. Case No. 656 of 2024, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure / Section 482(2) of the Bhartiya Nagarik Suraksha Sanhita and with other following conditions:- (i) one of the bailors should be the family member/relative of the petitioner(s) who shall provide official document to show his/her bona fide;
(ii) the petitioner(s) shall appear on each and every date before the Trial Court and failure to do so for two consecutive dates without plausible reason will entail cancellation of his/her/their bail bond by the Trial Court itself; (iii) the petitioner(s) shall in no way try to induce or promise or threat the witnesses or tamper with the evidences,
4/4 failing which the State shall be at liberty to take steps for cancellation of the bail bonds;
(iv) the petitioner(s) shall desist from committing any criminal offence again, failing which the State shall be at liberty to take steps for cancellation of their bail bonds. (Ajit Kumar, J) sharun/- U T
