The petitioner seeks bail in case registered for the offence under Sections 341, 323, 307, 385 and 504/34 of the Indian Penal Code.

The informant, Sumant Singh, made an allegation that while he was sitting at his Darwaja, the petitioner and other accused persons came there and demanded extortion. Subodh Singh alleged to have assaulted the informant with iron rod and

Learned counsel for the petitioner submits that prior to lodging of this case, Narhat P.S. Case No. 49 of 2014 was registered under Section 302 and other sections of the Indian Penal Code against the son of the informant namely, Santosh Singh. Narhat P.S. Case No. 88 of 2013 was registered against Akhilesh Singh & Ors. Learned counsel for the petitioner further submits that since the son of the informant is an accused for the offence registered under Section 302 of the Indian Penal Code for the murder of brother of the informant and that is the reason this false case has been lodged. The injury of the informant is not grievous The informant later on brought City Scan to show that he received grievous injury.

It appears that there is litigation between the parties. The son of the informant is an accused in a murder case of the brother of the petitioner. From the side of the petitioner many cases have been lodged.

Considering the facts aforesaid and the petitioner is in custody since 19.10.2014, petitioner, named above is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the
