Petitioner is apprehending his arrest in connection with a case registered for the offences under Section 307 and other allied Sections of the Penal Code. He is named in the First Information Report along with two others and 4-5 unknown. The injury caused to the members of the prosecution party of the instant case was not produced before the Sessions Judge in spite of indulgence granted to the prosecution.
Let petitioner surrender in the court below within a period of four weeks from the date of receipt/ production of a copy of this order in the court below and apply for regular bail, which should be considered in the light of the nature of injury.
Patna High Court Cr.Misc. No.40371 of 2015 (2) dt.08-10-2015 2/2 Necessary verification of the injury be made within a period of two weeks from the date of receipt/ production of a copy of this order after calling for the case diary. In the event, injuries are found simple, petitioner, named above, be released on bail on furnishing bail bond of Rs. 5,000/-(Rs. Five Thousand ) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Siwan, in connection with Maharajganj P.S. Case No. 243/14, subject to the conditions laid down under Section 438(2) Cr.P.C. Until such verification no coercive steps be taken against the petitioner. In case, injuries are found grievous the court below shall pass appropriate order in accordance with law.
This petition is, accordingly, disposed of.
