JUSTICE ASHWANI KUMAR SINGH ORAL ORDER 3 28-01-2015 In a case of misuse of privilege of bail the prayer for bail of the petitioner was rejected by this Court on 30th August, 2013 in Cr. Misc. No. 36834 of 2013 with the following observations:- "However, the trial court is directed to expedite the trial of Sessions Trial No. 432 A of 1994 arising out of Isuapur P.S. Case No. 75 of 1993, pending the court of Adhoc A.D.J.-V, Saran at Chapra and conclude the same within a period of one year from the date of receipt/production of a copy of this order. In case, the trial is not concluded within the time stipulated hereinabove, the petitioner would be entitled to renew his prayer for bail."
Patna High Court Cr.Misc. No.2048 of 2015 (3) dt.28-01-2015 2 / 2 It has been contended that petitioner is in custody since 29th June, 2013 and till date not even a single witness has been examined.
Regard being had to the observations made in the aforesaid order dated 30th August, 2013, the petitioner is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Saran at Chapra in S. Tr. No. 432A of 1994 arising out of Isuapur P.S. Case No. 75 of 1993.
