The petitioner is languishing in custody for the offences punishable under Sections 272, 273/34 of the I.P.C. and Section 30(a) of the Bihar Prohibition and Excise Act, 2018. Huge quantity of liquor was recovered from a truck. The petitioner was also there on the truck. Petitioner is in custody since 04.11.2020. Petitioner has stated on oath that he has got no criminal antecedent.
Considering the nature of allegation of recovery of commercial quantity of liquor, let the petitioner, above named, be released on bail only after framing of the charges so that the trial may not hamper, on furnishing bail bond of Rs.
Patna High Court CR. MISC. No.10346 of 2021(2) dt.30-06-2021 2/2 20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of the learned Court-below where the case is pending in connection with Minapur P.S. Case No. 433 of 2020, with following conditions:
(a) Both the bailors shall be the resident of territorial jurisdiction of the learned Court-below.
(b) The petitioner shall fully cooperate with the investigation/trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner. (Birendra Kumar, J) shahzad/- U T
