JUSTICE DINESH KUMAR SINGH ORAL ORDER 22-01-2015 Heard learned counsel for the petitioner and the State. The petitioner is languishing in custody since 18/11/2014 in a case registered for the offences punishable under Sections 7 and 13(2) read with 13(1)(D) of the Prevention of Corruption Act.

On information given by one Md. Umar Khan that the petitioner is demanding Rs. 3 lacs for preparing measurement book, a trap was laid. He was caught red handed while accepting illegal gratification of Rs. 50,000/-.

Learned counsel for the petitioner submits that measurement book was prepared prior to trap and recovery was not from the possession of the petitioner.

Patna High Court Cr.Misc. No.2693 of 2015 (2) dt.22-01-2015 2/2 This fact has not been disputed by learned counsel for Vigilance Department that the investigation has already been concluded. Considering the aforesaid facts, let the above named petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge, Vigilance (North Bihar) , Muzaffarpur in Special Case No.73/2014 arising out of Vigilance P.S.Case no.85/14.
