The petitioners apprehend their arrest in Kurhani (Turki O.P.) P.S. Case No. 74/2016, registered for the offences punishable under Sections 147, 148, 323, 324, 307, 379, 504 of the Indian Penal Code.
The informant named the petitioners along with other accused persons and alleged that having armed with different weapons the petitioners came to her house and asked her son Sonu Kumar to withdraw Kurhani P.S. Case No. 262/2014 registered under Section 307 and other Sections of the Indian Penal Code. It is alleged that when the informant and her son protested Swaraj Jha assaulted her son Chanchal Kumar with iron rod, Sintu Jha
Patna High Court Cr.Misc. No.26693 of 2016 (4) dt.01-09-2016 2/2 also assaulted her son with bricks and Chandan Kumar, petitioner no. 4 assaulted Chanchal Kumar with stick. Satyanarayan Jha assaulted the informant with stick on her head. It is submitted that there is a counter version being Kurhani P.S. Case No. 51/2016. It is further submitted that the injuries found on the person of Rita Devi, the informant, is simple in nature. The injury of Chanchal Kumar was kept reserved, but the assailant of Chanchal is Swaraj Jha and Sintu Jha. Chandan Kumar is alleged to have assaulted Chanchal Kumar with stick but no such injury was found on the body of Chanchal Kumar.
Considering the facts aforesaid and the fact that the injuries found on the person of the are simple in nature, the petitioners above named in the event of their arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, are directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of Sri Manish Kumar Pandey, Judicial Magistrate 1st Class, Muzaffarpur in connection with Kurhani (Turki O.P.) P.S. Case No. 74/2016, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
