The petitioner seeks regular bail in connection with Bakhtiarpur G.R.P.S. Case No. 229 of 2017, registered for the offence punishable under Section 395 of the Indian Penal Code.
The allegation is regarding unknown accused persons having snatched mobile phone and Rs. 50,000/- cash from the informant as also having committed theft in the train.
The learned counsel for the petitioner has submitted that the petitioner is not named in the F.I.R., no Test
Patna High Court Cr.Misc. No.76533 of 2018(2) dt.11-01-2019 2/2 Identification Parade has been held, no recovery has been made from the petitioner herein and the petitioner has been falsely implicated in the present case as well as remanded in the present case after being arrested in one other case. Thus, the submission of the learned counsel for the petitioner is that there is no material to connect the petitioner with the alleged crime.
Having regard to the facts and circumstances of the case, I deem it fit and proper to enlarge the petitioner on regular bail.
Accordingly, the above named petitioner is directed to be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M. Railway Patna Junction in connection with Bakhtiarpur G.R.P. Case No. 229 of 2017. (Mohit Kumar Shah, J) ajay gupta/- U T
