Mr. Nagendra Prasad Yadav, SC-23 ====================================================== CORAM: HONOURABLE MR. JUSTICE P. B. BAJANTHRI ORAL JUDGMENT Date : 29-01-2022 The matter is heard via video conferencing due to circumstances prevailing on account of the COVID-19 pandemic.
2. State counsel accept notice for respondents.
3. In the present petition, petitioner has prayed for following reliefs:
"(a) For issuance of writ in the nature of mandamus directing and commanding the Respondents to pay travelling allowance to the petitioner who was deputed for discharge of her duty during Covid-19 from J.L.N.M.C. Hospital, Bhagalpur to Sadar Hospital Bhagalpur from
Patna High Court CWJC No.3319 of 2021 dt.29-01-2022 2/3 10.04.2020 to 20.07.2020 and due to lock down there was no any transportation was provided by the respondents and hence petitioner discharged her duty from her quarter to Sadar Hospital by private vehicle and paid cost of fare Rs. 400/- per day for up and down from her own pocket.
(b) For issuance of writ in the nature of mandamus directing and commanding the Respondents to allot quarter of either Block-A or Block-B to the petitioner because the petitioner is unable to live with her family in room no. 5 old Nursing Hostel in which bath room is common and petitioner was/is always suffering from many infection/diseases and many junior grade-A nurses have already been allotted Block A quarter which is more facilitate than to old Nursing Hostel.
(c) For issuance of writ in the nature of mandamus directing and commanding the Respondents no. 4 to take an appropriate action against Rita Kumari, Anjani Kumari, Sarita Sinha and Kalpana Kumari who are Grade A Nurses and junior to the petitioner for committing torture by abusing the petitioner during discharge of her duty and also given threatening to leave out from her quarter due to infection of Corona of her brother.
(d) To grant any other relief or reliefs under which the petitioner found entitled to the fact and circumstances of the case."
4. In support of the aforesaid relief petitioner submitted representation/application, vide Annexures- 3 to 6.
5. Therefore, the concerned authority is hereby directed to examine the petitioner's application/representation and grant relief in accordance with law within a period of one
Patna High Court CWJC No.3319 of 2021 dt.29-01-2022 3/3 month from the date of receipt of this order, failing which petitioner is entitled to litigation cost and it is quantified @ Rs. 25,000/-.
6. With the above observations, the instant petition stands disposed of.
