JUSTICE DINESH KUMAR SINGH ORAL ORDER 29-09-2015 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 323/341/325/307/379 of the Indian Penal Code.

It is alleged that the FIR named accused persons including the petitioner assaulted the informant, his wife, daughter and son.

It is submitted by learned counsel for the petitioner that accusation of assault is omnibus and general. There is counter version of the occurrence also and all the injuries have been found to be simple in nature except one injury, with regard to wife of the informant, for which opinion has been kept reserved. Moreover, statement has been made in paragraph 3 of the petition that the petitioner has no criminal antecedent.

No.38639 of 2015 (2) dt.29-09-2015 2/2 Considering the omnibus and general nature of accusation, the petitioner having no criminal antecedent and coaccused have been granted anticipatory bail vide Criminal Miscellaneous No.46214 of 2014, let the above named petitioner be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned CJM, Saran at Chapra in connection with Chapra Muffasil P.S. Case No.127 of 2014, subject to the conditions as laid down under Section 438(2) Cr.P.C.
