Petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 341, 323, 307, 504, 506 of the Indian Penal Code and 27 of the Arms Act.
The prosecution case is that the informant was driving the tractor and reached near Panchayati Bhawan, then petitioner pulled down the informant from the tractor and 6-7 unknown persons fired with arms and caused injury to the informant. When owner of the tractor came he took the informant to hospital.
It is submitted by the learned counsel for the petitioner that admittedly no injury has been caused to the
Patna High Court Cr.Misc. No.35842 of 2016 (2) dt.06-09-2016 informant. Statement has been made in para-3 of the petition that petitioner has no criminal antecedent.
The aforesaid facts constitute ground for consideration of prayer for bail on surrender before the learned court below within a period of six weeks from today in connection with Jagdishspur P.S. Case No. 79 of 2016, pending in the court of learned Chief Judicial Magistrate, Bhagalpur. With this observation this application is disposed of.
