The petitioner is apprehending his arrest in Wazirganj P.S. Case No.488/16 registered for the offences under Sections 420, 467, 468, 471 and 409 of the Indian Penal Code. Accusation is that the petitioner was appointed as Panchayat teacher on the basis of the Medical Certificate issued regarding handicap by Civil Surgeon- Chief Medical Officer, East Champaran, Motihari 24.12.2005. On verification it was found that the Medical certificate At Serial No.615 on 24.12.2005 was issued in the name of Subhash Ram.

Learned counsel for the petitioner submits that the disabled certificate was issued in favour of the petitioner by the office of the Civil Surgeon-cum-Chief Medical Officer, East

Patna High Court Cr.Misc. No.18256 of 2017 (5) dt.08-08-2017 2/2 Champaran, Motihari vide Memo No.2305 dated 24.12.2005 but due to mistake in place of Memo No.2305 dated 24.12.2005 Memo No.615 was detailed. The father of the petitioner got certified copy of the entry of the Issue Register in which the name of the petitioner has been shown at Serial No.2305 on 24.12.2015which would appear to Annexure-2 series of Supplementary affidavit.

Having considered the facts and circumstances of the case, let the petitioner, above named, in the event of his arrest or surrender before the court below within four weeks from today, be released on bail on furnishing bail bond of Rs.10,000/-with two sureties of the like amount each to the satisfaction of A.C.J.M., Gaya, in Wazirganj P.S. Case No.488/16 subject to the conditions as laid down under Section 438(2) Cr.P.C.
