JUSTICE RAKESH KUMAR ORAL ORDER 28-01-2016 Three petitioners apprehending their arrest in connection with SC /ST Buxar P.S. Case No. 33 of 2014 registered for the offence punishable under Section 406, 409, 420, 120(B) of the Indian Penal Code and Section 3(i)(x) of the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities ) Act, 1989 have prayed for grant of anticipatory bail. On perusal of the F.I.R. it is evident that in the garb of running a bank it has been alleged that petitioners have committed fraud with number of villagers and collected huge amount and on demand they were abused. In this case one of the provision has been made applicable i.e. provision of the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act, 1989.

Patna High Court Cr.Misc. No.40647 of 2015 (3) dt.28-01-2016 2/2 In view of the facts and circumstance there is no reason to grant anticipatory bail.

The petition stands dismissed.
