JUSTICE VINOD KUMAR SINHA ORAL ORDER 11-09-2019 Petitioner seeks bail in anticipation of his arrest in connection with Complaint Case No. 489(c) of 2018 in which cognizance has been taken under Sections 323, 498A of the Indian Penal Code and Sections 3/4 of Dowry Prohibition Act. Allegation against the petitioner, who happens to be husband of the complainant, is that he demanded a car and for that he assaulted her and got her pregnancy aborted. Submission of learned counsel for the petitioner is that he is a guard at Bombay and allegation is false and concocted and he is still ready to keep her and the stand of petitioner in the court below was that petitioner has to live with his parents and for that she was not ready and there was no

In view of above facts and circumstances, let petitioner, in the event of surrender, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the Sub-Divisional Judicial Magistrate, Barh, Patna, in connection with Complaint Case No. 489(c) of 2018, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. and further condition is that one of the bailors of the petitioner shall be a local person having sufficient immoveable property within the jurisdiction of the court concerned and further condition is that if any maintenance case is filed by the complainant the petitioner has to co-operate in disposal of the same and he has to abide by any order, either interim or final, passed by learned Family Court unless the same is modified or set aside by any higher court.
