JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 28-09-2015 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

Petitioner and three others are said to have opened fire on the deceased.

No doubt, petitioner is in jail custody since long but the postmortem report of the deceased prima facie corroborates the allegation. The charge against the petitioner was framed on 07-042015 and the case is pending for recording the prosecution evidence.

Regard being had to the facts and circumstances of the case as well as submission of the parties, I am not inclined to release the petitioner on bail and hence, his prayer for bail in

Patna High Court Cr.Misc. No.23969 of 2014 (5) dt.28-09-2015 2/2 connection with Sessions Trial No. 142 of 2015 arising out of Rajepur P.S. Case No. 76 of 2011 pending in the court of learned Additional Sessions Judge-VII, East Champaran, Motihari/concerned court stands rejected.

However, the learned trial court is directed to expedite the trial of the petitioner and try to conclude the same as early as possible.
