The petitioner seeks bail in connection with Piar P.S. Case No. 155 of 2018 instituted for the offence under Section(s) 414/34 of the Indian Penal Code.

Learned counsel for petitioner submits that no motorcycle has been recovered from conscious possession of this petitioner.

It is mentioned in the seizure list that motorcycle has been recovered from near house of this petitioner. In the written report it is alleged that police raided the house of co-accused Pappu Ram and Arjun Ram and recovered stolen motorcycle from their possession. It is further alleged that co accused Pappu Ram disclosed the name

Patna High Court Cr.Misc. No.74455 of 2018(2) dt.13-12-2018 2/2 of this petitioner. Thereafter, police raided the house of this petitioner and recovered Apache motorcycle from near the house of petitioner.

Petitioner is in custody 1. 9.2018 since having no criminal antecedent.

Considering the aforesaid, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/-(Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate First Class, Muzaffarpur in connection with Piar P. S. Case No. 155 of 2018 (G.R. Case No. 5597 of 2018), subject to the condition that both the bailers shall be the close relative of the petitioner.. (Sanjay Priya, J) shyambihari/- U T
