2. Petitioner apprehends arrest in a case registered for the offence punishable under sections 307, 385, 386 and some other sections of the IPC and section 27 of the Arms Act.

3. It is submitted on behalf of the petitioner that specific accusation of demanding extortion and firing is against co-accused Ejaj and Md. Amir and no overt act has been alleged against this petitioner and as a mater of fact petitioner is a labourer and at the relevant time he was in Delhi. Petitioner claim clean antecedent.

4. Learned counsel for the State opposes the prayer for pre-arrest bail.

5. Considering the aforesaid facts of the case, prayer for bail of this petitioner is allowed. In the event of arrest/surrender within eight weeks from today, let this petitioner, mentioned above, be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Bhagalpur in Kotwali Police Station Case No. 522 of 2022,
