The petitioner is apprehending his arrest in connection with Siwan (Town) P.S. Case No. 374 of 2018 for the offence under Sections 379 of the Indian Penal Code.
Learned counsel appearing on behalf of the petitioner would submit that the name of the petitioner was disclosed by co-accused Saif Ali and he has sold stolen motorcycle to this petitioner. Learned counsel for the petitioner further submits that vehicle in question was not purchased by the petitioner. The said motorcycle was not recovered from the possession of the petitioner or his residence but the same was recovered from the ditch of one Premchand Manjhi.
Considering the aforesaid, let the petitioner above
Patna High Court Cr.Misc. No.74321 of 2018(2) dt.20-12-2018 2/2 named, in the event of arrest or surrender within one month from today, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the Court of learned Chief Judicial Magistrate-Siwan in connection with Siwan (Town) P.S. Case No. 374 of 2018, subject to the conditions as laid down under Section 438 Cr.P.C.
