JUSTICE DINESH KUMAR SINGH ORAL ORDER 22-09-2015 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 376,506 and 120B of the Indian Penal Code and section 4 of Protection of Children from Sexual Offences Act.

The prosecution case is that the petitioner ravished the informant after dragging into the maize field on 14.2.2015 and subsequently promised to marry but die not perform marriage. It is submitted by the learned counsel for the petitioner that for the occurrence of 14.2.2015 the FIR was registered on 10.3.2015 and now the petitioner has married with the informant. It is further submitted that as per medical examination the victim was assessed between 16 to 17 years of age.

No.38121 of 2015 (2) dt.22-09-2015 2/2 Let the learned court below consider the prayer for regular bail of the petitioner keeping in view the delayed lodging of the case and the present stand of the petitioner that the informant is residing with the petitioner as wife, in case the petitioner surrenders within six weeks from today in connection with Katihar (Mahila) P.S. Case No. 12 of 2015 pending in the court of learned Additional Sessions Judge-I cum Special Judge, Katihar. This application is disposed of with the aforesaid observation/direction.
