JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 07-04-2022 Heard learned counsel for the petitioner and learned Additional Public Prosecutor appearing on behalf of the State. This application for grant of regular bail arises out of Nokha P.S. Case No. 140 of 2019, registered for the offence punishable under Section 392 of the Indian Penal Code. The First Information Report was registered against unknown with the allegation that the informant was intercepted by the three miscreants and, on gun point, they snatched the informant's motorcycle and a bag containing some cash. Learned counsel appearing on behalf of the petitioner has submitted that his name surfaced during the course of investigation on the basis of confessional statement of a co-accused Tuntun Kumar, who has been allowed regular bail by this Court by an order dated 17.12.2020 passed in Cr. Misc.

Patna High Court CR. MISC. No.63351 of 2021(2) dt.07-04-2022 2/2 No. 33165 of 2020. The petitioner is in custody since 28.06.2021 Considering the period of incarceration and the nature of accusation as well as the fact that the co-accused Tuntun Kumar has been allowed regular bail by this Court, this application is allowed.

Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned J.M.-I, Sasaram, Rohtas, in Nokha P.S. Case No. 140 of 2019.

However, from the averments made in paragraph 3 of this application, it appears that the petitioner has criminal antecedents. In such circumstance, it is observed that if the petitioner is found indulging in commission of offence in future, the prosecution shall be at liberty to approach this Court for cancellation of bail granted to him by virtue of the present order.
