2. The petitioner is in custody in a case registered for the offence punishable under Section 394 of the Indian Penal Code.
3. As per allegation in the FIR, petitioner along with other co-accused persons snatched a bag of the informant containing amount of Rs.98,110/- along with other documents at the gun point.
4. Learned counsel for the petitioner submits that petitioner has falsely been implicated in this case. He next submits that neither any incriminating article has been recovered from the possession of the petitioner nor test identification parade
Patna High Court CR. MISC. No.56306 of 2024(2) dt.19-08-2024 2/2 has been conducted by the police and so far as concern to criminal antecedent of the petitioner, police in any case of loot in the locality, implicate the petitioner without any evidence. He is in custody since 29.05.2024.
5. Learned APP for the State opposes the prayer for bail of the petitioner.
6. In the aforesaid facts and circumstances of the case, let the petitioner above named be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned ACJM-I, Purnia in connection with Banmankhi P.S. Case No. 439 of 2023 with condition that petitioner shall remain present on each and every date before the trial Court till conclusion of the trial. (Ramesh Chand Malviya, J) Brajesh Kumar/- U T
