The petitioner seeks bail in Sathi P.S. case No. 116 of 2018 registered under Section 308, 354B, 379 and some other minor Sections of the Indian Penal Code and u/s 3⁄4 of Prevention of Witch Practices Act.

The informant named the petitioner along with other accused persons and alleged that petitioner and others on the allegation of witch practicing abused the informant, torn her clothes and assaulted her with iron rod, Farsa and other weapons.

The learned counsel for the petitioner submits that there is counter version being Sathi P.S. case No. 119 of 2018. The informant received simple injuries and the petitioner is in jail since 11.09.2018. The petitioner has already remained in jail

Patna High Court Cr.Misc. No.75209 of 2018(2) dt.17-12-2018 2/2 for more than three months.

Considering the facts aforesaid and nature of allegation made against the petitioner and the fact that there is case and counter case and the petitioner and others are alleged to have assaulted the informant with iron rod, Farsa and other weapons but no specific allegation is made against the petitioner, the petitioner, above named, is directed to be enlarged on bail on his furnishing bail bond of Rs. 10,000/- (rupees ten thousand) with two sureties of the lime amount each to the satisfaction of learned Chief Judicial Magistrate, West Champaran, Bettiah in connection with Sathi P.S. case No. 116 of 2018.
