2. The petitioners apprehend arrest in a case registered for the offence punishable under Sections 304B/201/34 of the Indian Penal Code.
3. It is a case of dowry death.
4. Learned counsel for the petitioners submits that the petitioners are innocent and has falsely been implicated in this case. There is general and omnibus allegation against the petitioners and no specific overt act has been alleged against them. Petitioner No.1 is father-in-law and petitioner No.2 is mother-in-law of the deceased. It is further submitted that the
Patna High Court CR. MISC. No.54329 of 2023(2) dt.21-08-2023 2/2 petitioner is separate in mess and business. Thrust of allegation is against the husband of the deceased who is in custody. Petitioners have clean antecedent.
5. Considering the aforesaid facts and circumstances of the case, in the event of arrest or surrender within six weeks from today, let the petitioner, as named above, be enlarged on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate 6th, Nawada in connection with Hisua P.S. Case No.425 of 2022, subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure.
