Heard learned counsel for the petitioner and learned A.P.Ps. for the State.
The petitioner seeks regular bail in connection with Laxmipur (Gidhaur) P.S. Case No. 72 of 2020 lodged under
Patna High Court CR. MISC. No.10292 of 2021(6) dt.26-09-2022 2/2 Section 302 of the I.P.C.
As per the prosecution case, the informant has disclosed that the petitioner was assaulting his mother. The deceased went there to save but the informant attacked on the deceased by scissor on the chest, in result, deceased died on the spot.
Learned counsel for the petitioner submits that petitioner is innocent and his antecedent is clean. There is neither motive nor intention behind this action of the petitioner. He submits that petitioner is in custody since 01.03.2020, charge sheet has already been filed in this case.
Learned counsel for the State opposes the prayer for bail and submits that only 2 points that the mother of the petitioner is one of the eye witness of this case and second that on the disclosure of the petitioner, the weapon used in the murder has been recovered by the police.
In the present facts and circumstances of this case and the submissions made above, I am not inclined to grant bail to the petitioner, therefore, his bail petition is hereby rejected. With this observation, the bail application stands rejected.
