Petitioner seeks bail in Excise Special Case No.1338 of 2018 arising out of Forbesganj P.S. Case No.825 of 2018 instituted for the offence under Section(s) 30(a), 38(i) of Bihar Prohibition and Excise Act, 2016.

It is alleged that 800 bottles of cough syrup each of 100 ml. total 80 litres has been recovered from the car being loaded in Banswari.

Counsel for the petitioner submits that seizure list is part of the First Information Report, which does not bear signature of the petitioner.

Petitioner is in custody since 27.10.2018 having clean antecedents.

Let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the 2nd Additional Sessions Judge cum Special Judge, Araria, in connection with Excise Special Case No.1338 of 2018 arising out of Forbesganj P.S. Case No.825 of 2018, subject to the condition that both the bailors shall be close relative of the petitioner.
