The petitioner apprehends his arrest in a case under Section 302 and other sections of the Indian Penal Code. The informant alleged that 22 persons including the petitioner assaulted him and his father with fists and slaps. Bidur Mandal assaulted his father with water pot on his chest and consequently his father died.
It is submitted that no other injury was found on the person of the deceased and similarly situated accused Pankaj Mandal and Pawan Kumar Mandal have already been enlarged on anticipatory bail.
Having considered the fact that case of the petitioner stands on the same footing as that of accused Pankaj Mandal and
Patna High Court Cr.Misc. No.38344 of 2015 (3) dt.30-11-2015 2/2 Pawan Kumar Mandal, the above named petitioner, in the event of his arrest or surrender before the learned court below within a period of four weeks from the date of receipt / production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate, Araria in Jogbani P.S. Case No. 101 of 2014, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
