The present application has been filed for quashing the order dated 22.5.2014 passed by the learned Judicial Magistrate Ist Class, Rohtas at Sasaram in Complaint Case No. 148 of 2013 whereby process has been directed to be issued after cognizance being taken for the offence punishable under section 498A of the Indian Penal Code. By filing supplementary affidavit, it is very fairly submitted by learned counsel for the petitioner that two witnesses have been examined under section 244 Cr.P.C. at pre-charge level.

In the circumstances, in view of the change of stage of the proceeding, this application is disposed of with a liberty to the petitioner to raise his contentions at the

Patna High Court Cr.Misc. No.30781 of 2016 (2) dt.24-05-2017 2/2 appropriate stage of proceeding.
